Montana is one of the strict states. Under MCA 39-3-205, an employee you terminate must be paid on the day of discharge; someone who resigns gets more room. In full: Fired: immediately, unless a written policy extends to the next payday or 15 days, whichever is earlier. Quit: next payday or within 15 days, whichever comes first. Pick the separation type, enter the last day and your next payday, and the calculator returns the latest date you can legally pay. Accrued PTO payout is a separate Montana rule and is not included. Related: the Montana minimum wage, the HR compliance risk check for the termination process, and the all-state calculator. Nearby: Idaho, Wyoming and North Dakota.
CoAd Pay issues off-cycle final checks the same day, applies the state deadline and PTO rule, and files the paperwork. HR support for the termination is one add-on away.
